U ovom slucaju nije proglaseno ratno stanje i helikopter nije ucestvovao u recimo borbenoj operaciji protiv terorista. Helikopter je angazovan u cilju medicinskog zbrinjavanja civila sa civilnim lekarskim osobljem i kao potreba za prebacivanjem do adekvatne civilne ustanove i slazemo se da je naredba komandanta neprikosnovena. Jedino to sto je od trenutka poletanja do trenutka sletanja pilot taj komandant bez obzira da li je rec o vojnom, policijskom ili civilnom helikopteru.
